A lot of difficulties can arise when a person becomes incapable of fending for themselves when requiring health care, and so cannot take care of their health related treatment and care concerns. Filling out an advance health care directive is a must for anyone above 18 years of age as it will be used in case a person meets with an accident or suffers some other serious illness and is in a state where he or she cannot speak or give instructions concerning their ill health or traumatized condition. The advance health care directive permits a person to appoint an agent who will have a power of attorney to facilitate giving instructions about their health care as well as deciding on care and health treatment.

It is the right of every mature adult to make decisions regarding their health and this includes the right to make a choice regarding their health care, which may also include the right to refuse medical treatment. It is common for people to go into coma or to have debilitating diseases such as Alzheimer's disease, which results in the patient becoming incapacitated and to facilitate that the patient gets adequate and timely treatment. The advance healthcare directive is the document recognized by law, which will direct the health care authorities how to care for the patient, according to the instructions given in the directive, which may include providing, withholding or withdrawing life-prolonging procedures. The directive may also appoint an individual to make decisions on behalf of the patient as well as making anatomical donations upon death.

It is also a requirement of the law that the hospital, nursing home, home health agency, hospice and other health maintenance organizations gives their patients written information such as pamphlets



that deal with health care advance directives. The directive can be written or oral and should address how the medical treatment should be handled in the event of incapacitation of the patient. It is normal for people to make a health care advance directive when they get struck down by a life threatening disease, though others may prefer to make a directive while still enjoying good health. There are three types of healthcare advance directives and these are a living will, a health care surrogate designation and an anatomical donation. It is up to the person to choose one, two or all three of these forms of directives.

Anybody can make a health care advance directive and having an attorney prepare one is not a necessity but the court appointed guardian, wife or husband, an adult child or a parent, adult relative or adult sibling are also competent to frame directives regarding health care and anatomical donations. It is also possible to make changes to the directive, including cancelling the health care advance directive. In addition, a healthcare advance directive prepared in one state may also be legal for use in another state.
